Meghan’s Homeware Empire Hits Major Roadblock
Meghan Markle’s attempt to trademark her new homewares business, ‘American Riviera Orchard,’ has been denied. The U.S. Patent and Trademark Office (USPTO) rejected her application, saying the name is a well-known Santa Barbara, California nickname.
The Duchess of Sussex has been given three months to respond to the USPTO’s ‘nonfinal officer action.’ This delay comes simultaneously with her brand’s product launch being pushed back. Even though her brand had a flashy Instagram debut five months ago, no products have been made available to the public yet.
The USPTO has denied Meghan’s trademark request for several reasons in a 48-page report. They pointed out the need to remove the word ‘Riviera’ and follow the multi-class application rules. Plus, the product descriptions for cooking utensils, pans, and cocktail napkins were too vague.
Meghan must also pay an extra $700 (£532) because the correct amount wasn’t paid before. Also, her legal team didn’t fill out or sign the form correctly. The brand’s website and Instagram are pretty empty, and there is no way to make a purchase. Previously, the actress caused quite a buzz online when she sent jam jars to influencers and famous friends.
However, the limited promo hasn’t led to a full product launch yet. An insider told The Express, “It would be a surprise if Meghan had not received one before in trying to get her application through.” The source also mentioned that Meghan is committed to her brand and expressed confidence that this would not result in her giving up.
